9. Legal warranties
Mandatory information box — Legal warranties (annex to article D211-2 of the French Consumer Code)
The consumer has a period of two years from delivery of the goods to obtain the implementation of the statutory conformity warranty in the event that a conformity defect appears. During that period, the consumer is only required to establish the existence of the conformity defect and not the date on which it appeared.
Where the contract of sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period exceeding two years, the statutory warranty applies to that digital content or digital service throughout the agreed period. During that period, the consumer is only required to establish the existence of the conformity defect affecting the digital content or digital service and not the date on which it appeared.
The statutory conformity warranty entails an obligation on the trader to provide, where applicable, all updates necessary to maintain the conformity of the goods.
The statutory conformity warranty gives the consumer the right to have the goods repaired or replaced within thirty days of making the request, at no cost and without major inconvenience.
If the goods are repaired under the statutory conformity warranty, the consumer benefits from a six-month extension of the original warranty (article L217-13 of the French Consumer Code).
If the consumer requests repair of the goods but the seller imposes replacement, the statutory conformity warranty is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract with a full refund in exchange for returning the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a thirty-day period;
3° The repair or replacement of the goods causes a major inconvenience to the consumer, in particular where the consumer bears the costs of collecting or removing the non-conforming goods definitively, or bears the installation costs of the repaired or replacement goods;
4° The non-conformity of the goods persists despite an unsuccessful attempt by the seller to bring them into conformity.The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the conformity defect is so serious that it justifies the immediate reduction in price or termination of the contract. The consumer is not then required to first request repair or replacement of the goods.
The consumer is not entitled to rescind the sale where the conformity defect is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining warranty period until the goods are returned in working order.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
A trader who in bad faith obstructs the implementation of the statutory conformity warranty is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the statutory warranty against hidden defects pursuant to articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty gives the consumer the right to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.
Statutory conformity warranty (art. L217-3 to L217-17 of the French Consumer Code)
DOMAINE LA BASTIDE BLANCHE — SCEA BRONZO delivers goods that conform to the contract and is liable for any conformity defects existing at the time of delivery. Any action arising from a conformity defect is time-barred after two years from delivery of the goods (art. L217-7).
Warranty against hidden defects (art. 1641 to 1649 of the French Civil Code)
DOMAINE LA BASTIDE BLANCHE — SCEA BRONZO is liable for hidden defects in the goods sold that make them unfit for the purpose for which they were intended, or that so diminish that use that the consumer would not have acquired them, or would only have paid a lower price, had they known of the defects. Any action arising from a latent defect must be brought by the purchaser within a period of two years from the discovery of the defect (art. 1648 al. 1 of the French Civil Code).
